Welcome to Karmic. The terms “we,” “us,” and “our” refer to Karmic. Karmic operates this online store and website, including all related information, content, features, tools, products, and services made available through the site (collectively, the “Services”).
Karmic is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced or incorporated into these Terms, describe your rights and responsibilities when you access or use the Services.
Please read these Terms of Service carefully. They contain important information regarding your legal rights and responsibilities, including warranty disclaimers, limitations of liability, and other provisions that may affect your use of the Services.

Product images are intended to provide a representation of the products offered. We do not guarantee that the colors, appearance, or other visual characteristics of a product will appear exactly as they do on your device.
Product descriptions, specifications, availability, and pricing may change at any time without notice. We reserve the right to modify or discontinue products at any time and to limit quantities available for purchase.
SECTION 3 — ORDERS
When you place an order through the Services, you are submitting a request to purchase the selected products. Karmic reserves the right to accept or decline an order at its discretion.
An order is not considered accepted until Karmic confirms the order and payment has been successfully received.
Please review your order carefully before submitting it. Because many Karmic products are made to order and may enter fulfillment shortly after purchase, cancellation requests may not be possible once an order has been accepted or submitted for fulfillment.
If we are unable to accept, modify, or fulfill an order, we will make reasonable efforts to notify you using the contact information provided with your order.
All purchases are subject to our Refund & Return Policy.
You represent and warrant that products purchased through the Services are for your personal or household use and are not being purchased for unauthorized commercial resale or export.
SECTION 4 — PRICES AND BILLING
Prices, discounts, promotions, and product availability are subject to change without notice.
The price charged for a product will be the price displayed at the time the order is placed and will be reflected in your order confirmation. Unless otherwise stated, prices do not include applicable taxes, shipping charges, customs duties, or import fees.
Karmic may offer promotions from time to time. Promotional offers may have additional terms and conditions. If there is a conflict between the terms of a promotion and these Terms of Service, the specific promotional terms will control.
You agree to provide current, complete, and accurate billing, payment, and account information for all purchases made through the Services.
You agree to promptly update your account information, including your email address and payment information, so that we can complete your transactions and contact you when necessary.
By submitting payment information, you represent and warrant that:
1. The payment information you provide is accurate and complete.
2. You are authorized to use the payment method provided.
3. Charges incurred by you will be honored by your payment provider.
4. You will pay all applicable charges, including product prices, shipping charges, and applicable taxes.
SECTION 5 — SHIPPING AND DELIVERY
Karmic products may be fulfilled and shipped through third-party fulfillment and shipping partners.
Shipping and delivery times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, weather, natural disasters, service interruptions, or other circumstances beyond our reasonable control.
Once an order has shipped, tracking information will be provided when available.
If your order is delayed, lost, damaged in transit, or marked as delivered but you have not received it, please contact us at support@karmicnow.com. We will work with our fulfillment and shipping partners to help resolve the issue.
SECTION 6 — INTELLECTUAL PROPERTY
The Services and their contents, including but not limited to Karmic trademarks, names, logos, product designs, text, graphics, photographs, images, videos, audio, product reviews, and the selection and arrangement of these materials, are owned by Karmic, its affiliates, or its licensors and are protected by applicable intellectual property laws.
These Terms permit you to access and use the Services for your personal, non-commercial use only.
You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit materials from the Services without our prior written permission, except as permitted by applicable law.
Nothing in these Terms grants you any ownership interest or license to Karmic’s intellectual property except for the limited right to access and use the Services as expressly permitted by these Terms.
Karmic’s names, logos, product names, designs, and slogans are trademarks of Karmic or its affiliates or licensors. You may not use them without prior written permission.
Shopify’s name, logo, product names, designs, and slogans are trademarks of Shopify. All other names, logos, product names, designs, and slogans appearing through the Services are the property of their respective owners.

We may provide access to tools and features offered by third parties as part of the Services.
Karmic does not necessarily monitor or control these third-party tools and does not guarantee their availability, accuracy, functionality, or suitability for your use.

Your use of third-party tools is at your own risk and discretion. You should review the applicable terms and policies of the relevant third-party provider before using any third-party tool.
Any new features, tools, or resources that we add to the Services in the future will also be subject to these Terms of Service unless otherwise stated.

Karmic is not responsible for examining or evaluating the content, accuracy, privacy practices, security, or availability of third-party websites or services.

Karmic is not responsible for any loss, damage, or other consequences resulting from your use of third-party websites, services, products, or content.
Questions or concerns regarding third-party products or services should be directed to the applicable third party.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
Karmic is powered by Shopify, which enables us to provide the Services to you. However, purchases made through our store are transactions between you and Karmic.
By using the Services, you acknowledge that Shopify is not responsible for any aspect of transactions between you and Karmic, including any injury, damage, or loss resulting from products purchased through our store.
You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions made with Karmic, to the fullest extent permitted by law.
SECTION 10 — PRIVACY POLICY
Personal information collected through the Services is subject to our Privacy Policy.
Because the Services are hosted by Shopify, Shopify may collect and process certain personal information regarding your access to and use of the Services in order to provide and improve its services.

You represent and warrant that:
1. You own or otherwise have all necessary rights to the Feedback you submit.
2. You have disclosed any compensation or incentives received in connection with your submission, where applicable.
3. Your Feedback complies with these Terms of Service and applicable law.
We are not obligated to maintain Feedback in confidence, provide compensation for Feedback, or respond to Feedback.
We may, but are not obligated to, monitor, edit, restrict, or remove Feedback that we determine in our discretion to be unlawful, offensive, threatening, defamatory, obscene, infringing, or otherwise objectionable.

You may use the Services only for lawful purposes.
You may not use the Services:

● To interfere with or restrict another person’s use or enjoyment of the Services.

● To reproduce, duplicate, copy, extract, sell, resell, or exploit portions of the Services except as expressly permitted.
● To collect or track personal information belonging to others without authorization.
● To engage in phishing, pharming, scraping, or similar activities.
● To use automated tools, bots, spiders, scraping tools, data-gathering tools, AI agents, or other automated or manual processes to access or interact with the Services in violation of applicable restrictions.
● To interfere with, bypass, or circumvent security or authorization features or other measures used to restrict access to the Services.
We reserve the right to suspend, restrict, disable, or terminate access to the Services if we reasonably determine that these Terms have been violated.

This section (“Agent Terms”) applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with the Services.
“Agent” means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person’s device without direct supervision.

No Agent may access, use, or interact with the Services unless, at all times, it identifies itself and operates in accordance with the requirements below. An Agent may not access, use, or interact with the Services if Karmic has requested that the Agent refrain from doing so.
14.3
Karmic may limit, including through technical measures, whether and how an Agent accesses, uses, or interacts with the Services.
14.4
Agents must:
1. Identify that the request is being made by an Agent and disclose the Agent’s name in applicable HTTP/HTTPS requests.
2. Not conceal or obfuscate the fact that interactions are being performed by an Agent.
3. Not mimic human behavior or interaction patterns for the purpose of circumventing restrictions.
4. Not complete or circumvent CAPTCHAs or other measures designed to distinguish automated access from human access.
5. Respond truthfully when asked whether interactions are being performed by a human or computer.
6. Not circumvent or avoid measures intended to block, limit, modify, or control Agent access to the Services.
SECTION 15 — TERMINATION
We may terminate or suspend your access to the Services, or terminate these Terms, at our discretion and to the extent permitted by applicable law.
You remain responsible for all amounts owed up to and including the date of termination.
The following sections will survive termination where applicable: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.
SECTION 16 — DISCLAIMER OF WARRANTIES
The information presented through the Services is provided for general informational purposes. We do not warrant that information available through the Services is accurate, complete, current, or useful for every purpose.

WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
SECTION 17 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, KARMIC AND ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, AND SHOPIFY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, CONSEQUENTIAL, OR SIMILAR DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.
THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, LOSS OF PROFITS, REVENUE, SAVINGS, DATA, REPLACEMENT COSTS, OR OTHER SIMILAR LOSSES, WHETHER ARISING IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
SECTION 18 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Karmic, Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, damages, liabilities, and reasonable attorneys’ fees arising from or related to:
1. Your breach of these Terms of Service or any policy incorporated into them.
2. Your violation of applicable law or the rights of a third party.
3. Your access to or use of the Services.
We will provide notice of an indemnifiable claim where reasonably practicable. A failure to provide prompt notice will not relieve you of your obligations except to the extent you are materially prejudiced.
Karmic may control the defense and settlement of an indemnified claim at your expense, including the selection of counsel. Karmic will not settle a claim that imposes non-monetary obligations on you without your consent, which will not be unreasonably withheld.
You agree to reasonably cooperate in the defense of indemnified claims.
SECTION 19 — SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law, and the unenforceable portion will be considered severed from these Terms.
The remaining provisions will remain in full force and effect.
SECTION 20 — WAIVER; ENTIRE AGREEMENT
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
These Terms of Service, together with the policies and operating rules posted on or in connection with the Services, constitute the entire agreement between you and Karmic concerning your use of the Services and supersede prior or contemporaneous agreements, communications, and proposals, whether oral or written.
Any ambiguities in the interpretation of these Terms will not be construed against the drafting party.
SECTION 21 — ASSIGNMENT
You may not transfer, delegate, or assign these Terms or any of your rights or obligations under them without our prior written consent.
Any attempted assignment in violation of this section is void.
Karmic may assign, transfer, or delegate these Terms and its rights and obligations without your consent or notice where permitted by law.
SECTION 22 — GOVERNING LAW
These Terms of Service and any separate agreements through which Karmic provides Services will be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict-of-law principles.
You and Karmic consent to the jurisdiction and venue of the state and federal courts located in North Carolina, to the extent permitted by applicable law.

The headings used in these Terms are provided for convenience only and do not limit or otherwise affect the interpretation of these Terms.

Karmic reserves the right, in its discretion, to update, change, or replace any part of these Terms by posting revised Terms on the website.
It is your responsibility to review these Terms periodically for changes.
Where required by applicable law, we will provide notice of material changes. Unless otherwise specified, changes become effective when posted.
Your continued use of or access to the Services after revised Terms are posted constitutes acceptance of those changes to the extent permitted by law.
